1. Definitions

For the purposes of this policy statement –

1. "LuxuryRes" "We", "Us" refer to LuxuryRes, Inc.
2. "Hotel" refers to any property or location listed in our System at which you may make a reservation.
3. "System" refers to the LuxuryRes Reservation System and Property Management System and LuxuryRes website (www.LuxuryRes.com) which may operate independently or in conjunction with each other.

2. The Data Controller of the data collected and processed through the System

1. Data Controller: This Reservation System or Property Management System (System) is owned and operated by the following Data Controller: LuxuryRes, Inc.; P.O. Box 541126, Houston TX 77254
2. Joint Data Controller: Your data can also be accessed and modified in the System by the Hotel at which you made a reservation via the LuxuryRes System.

3. How your personal data will be processed; security

1. We collect data to assist in processing your reservation. We have access to it and the hotel you book will have access to it.
2. The data collected through the System will be mainly processed by electronic means. We have adopted reasonable security measures to protect personal data against destruction or loss, including accidental loss, unauthorized access, unlawful processing, or processing that are not compliant with the purposes for which the data were collected as specified in this Privacy Policy. However, since the data will be transmitted via electronic networks, the above measures cannot limit or completely exclude the risk of unauthorized access or dissemination of the data.
3. We do not sell your data.

4. What data will be collected through the System, and purposes of their processing

We may collect personal data directly from individuals as well as automatically via their use of the System , including:

1. Information you provide: any data that you directly provide to us (including, without limitation, email address, personal details, password), such as when making a reservation, are processed for acknowledging receipt of your reservation, requests and delivering the service, providing you with all necessary assistance and information in relation to the reservation and or data that you have directly provided us by signing up for a frequent guest service.
2. Usage information: we may automatically collect information about your use of our System through cookies, web beacons, and other technologies: your domain name; your browser type and operating System; pages you view in the System; links you click; your IP address; the length of time you spend in the System; and the referring URL, or the webpage that led you to the System; access time; and device ID.

5. Disclosure of personal data

LuxuryRes communicates your data only as permitted by the law and as indicated below. We may disclose the information we collect, including personal information, as follows:

1. Reservations: We may disclose the information we collect from you to the hotel you booked via our System for the purpose of processing your reservation.
2. Disclosures for Legal Reasons. We may disclose information to a third party (i) in order to comply with a law, regulation, governmental requirement, court order, judicial proceeding or legal process, such as a subpoena or a search warrant, (ii) to address a violation of the law. (iii) to protect the rights, property or safety of LuxuryRes, its users or the public, or (iv) to allow LuxuryRes to exercise its legal rights or respond to a legal claim, including as evidence in litigation in which we may become involved.
3. Business Transfers. If our company or substantially all of our assets are acquired, or in the event of a merger or bankruptcy, your information may be among the transferred assets.
4. With your consent: In addition to the above purposes, we may disclose your personal information with your consent.

6. Marketing Communications

We will not send you any marketing communication. We suggest you contact the Hotel directly to verify their policy regarding marketing communications.

7. International Transfer

1. Your personal data may be collected by LuxuryRes and the Joint Data Controllers who may be located outside your home jurisdiction. Your personal data may also be disclosed to third parties which, acting in their capacity as data processors, carry out on behalf of the Joint Data Controllers specific services (including, without limitation, logistics services and IT services), affiliates and subsidiaries of the LuxuryRes group of companies, and other recipients of personal data – the names of which will be specified from time to time - which will autonomously process the data for the sole purpose of performing the agreement of the reservations booked and processed via the System (including, without limitation, the financial institutions in charge of providing remote card payment services through credit/debit cards) and only if such purpose is not in conflict with the purposes for which the data were collected and subsequently processed and, in any case, in a manner that is consistent with the law.
2. The data will not be disseminated, and will be transferred abroad only and if adequate levels of protection and sufficient safeguards, as provided for by the law, have been guaranteed.

8. Data subject’s rights

1. You may request information from LuxuryRes as to what personal data about you is held by LuxuryRes and how it has been used or disclosed, and you may request access to such data in an understandable form. You may also request correction or updating of your personal data. The data subject’s rights may be subject to exceptions, limitations or payment of fees, as authorized or required under applicable law.
2. The above rights may be exercised by sending the relevant request to the Hotel directly.
